How work permits and employment approval relate to a residency application, and what employers and employees need to do.

How residency and employment fit together

A residency application through employment depends on a valid employment contract that meets the criteria — see check if you can apply. Your employment must stay in place for your residence permit to remain valid.

If your employment ends, your permit can lapse. See your residency.

Work permits

Some workers need a work permit before they can be employed in Gibraltar. The Department of Employment is responsible for work permits.

Terms of Engagement

Employers register their employees through Terms of Engagement with the Department of Employment.

Guidance on Terms of Engagement — including when an unstamped Terms of Engagement is accepted, and when employment forms must be submitted — is being provided by the Department of Employment and will be published here.

If employment ends

A residence permit lapses 16 weeks after a Notice of Termination of Terms of Engagement is filed with the Department of Employment, unless the Director of Immigration and Home Affairs is satisfied that the person has a new employment contract. See your residency.
